Welcome to SecureGap.io, operated by SecureGap Technologies (OPC) Private Limited, incorporated under the laws of India ("SecureGap", "we", "our", or "us").
By accessing or using SecureGap.io (the "Platform" or "Service"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree, you must not use the Service.
1. Nature of the Service
SecureGap.io is an AI-assisted cybersecurity gap analysis and recommendation platform. The Service collects user-provided inputs about organizational environments, performs analytical processing using predefined frameworks and AI models, and generates informational insights, findings, and recommendations. SecureGap does NOT provide legal, regulatory, or compliance certification; act as an auditor, assessor, or implementation partner; or guarantee security outcomes, compliance, or risk elimination. All outputs are advisory in nature only.
2. No Professional Advice
The Service does not constitute legal advice, regulatory advice, compliance certification, or security assurance or warranty. You acknowledge that final decisions remain solely your responsibility; you must consult qualified professionals before acting on any recommendations; and SecureGap is not liable for actions taken based on Platform outputs.
3. Vendor Neutrality & Third-Party References
SecureGap may reference security vendors, tools, products, frameworks, and implementation partners. Such references are illustrative and non-exclusive; do not imply endorsement, partnership, or certification; and do not create any contractual obligation. SecureGap does not receive commissions unless explicitly stated in a separate written agreement.
4. User Responsibilities
You agree to provide accurate, lawful, and authorized information; ensure you have rights to submit organizational data; maintain confidentiality of login credentials; and use the Service only for lawful purposes. You must not reverse engineer, scrape, or misuse the Platform; use outputs as a substitute for audits or certifications; or misrepresent SecureGap outputs to regulators or third parties.
5. Data & Confidentiality
You retain ownership of all data you submit. SecureGap uses submitted data solely to provide the Service. We implement reasonable technical and organizational safeguards and do not sell customer data. Details are governed by our Privacy Policy, which forms part of these Terms.
6. AI Limitations & Accuracy Disclaimer
You acknowledge that AI outputs may be incomplete, outdated, or inaccurate; framework interpretations may evolve over time; and no AI system is error-free. SecureGap does not guarantee accuracy, completeness, or suitability for a specific regulatory or security objective.
7. Intellectual Property
All Platform content, including software, models, framework mappings, UI/UX, reports, and branding, are the exclusive property of SecureGap or its licensors. You receive a limited, non-transferable, revocable license to use the Service for internal purposes only. You may not resell reports, white-label outputs, or use SecureGap IP to build competing products.
8. Subscriptions, Billing & Refunds
Fees are charged as per the selected plan. All payments are non-refundable, unless required by law. SecureGap may revise pricing with prior notice. Abuse, misuse, or policy violations may result in suspension without refund.
9. Limitation of Liability
To the maximum extent permitted by law, SecureGap shall not be liable for security incidents, data breaches, regulatory penalties, business losses, or indirect or consequential damages. Total liability, if any, shall not exceed the amount paid by you in the last 12 months.
10. Indemnification
You agree to indemnify and hold harmless SecureGap from claims arising due to misuse of the Platform, violation of laws or third-party rights, unauthorized data submission, or misrepresentation of Platform outputs.
11. Suspension & Termination
SecureGap may suspend or terminate access for violation of these Terms, for security risks, for misuse or abuse, or for legal or regulatory reasons. Termination does not waive accrued rights or liabilities.
12. Modifications to the Service
SecureGap may update features, modify frameworks, change AI logic, and add or remove functionality. We may also update these Terms periodically. Continued use constitutes acceptance.
13. Governing Law & Jurisdiction
These Terms are governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of courts in Noida / Delhi NCR, India.
14. Force Majeure
SecureGap shall not be liable for failures caused by events beyond reasonable control, including natural disasters, internet outages, government actions, or AI provider outages.
